Legal notice

1. Purpose

This document informs users of the conditions governing the Easy Trends Agency website (“Easy Trends”, “we” or the “Site”), as well as their rights and obligations when using it. Access to the Site is free of charge and requires no registration, except in the sections that expressly require it.

This notice is adopted under the Political Constitution of Colombia, Law 1581 of 2012 and Decree 1074 of 2015 on personal data protection, Law 527 of 1999 on data messages and electronic commerce, Law 1480 of 2011 (Consumer Statute), and Law 23 of 1982 and Andean Decision 351 of 1993 on copyright.

The purpose of the Site is to present the services of Easy Trends, inform creators and clients about the campaigns we coordinate, and provide a contact and registration channel. The registered company name, tax ID and address for legal notices applicable to each contractual relationship are stated in the order, the specific agreement and the payment documents for each campaign.

3. Access and use

Accessing the Site makes you a user and implies acceptance of this legal notice in the version published at that moment. If you disagree with any of its conditions, please do not use the Site.

Use of private areas, creator registration and the campaign platform is additionally governed by the applicable terms and conditions and by the specific conditions of each campaign.

4. User obligations

When using the Site you agree to:

• use it in accordance with the law, good faith, public order and this legal notice;
• refrain from unlawful or fraudulent activity or activity that harms third-party rights;
• not impersonate another person or use false identities for commercial or any other purposes;
• not introduce or spread viruses, malicious code or any element that could damage the Site, its systems or those of third parties;
• not attempt unauthorised access to restricted areas, other people's accounts or systems connected to the Site;
• not extract, reproduce or reuse the content in bulk or by automated means without our prior written authorisation;
• be responsible for the truthfulness and accuracy of the information you send us through forms or contact channels.

Breach of these obligations entitles us to restrict or suspend access to the Site, without prejudice to any applicable legal action.

5. Intellectual and industrial property

All elements of the Site — text, photographs, illustrations, icons, logos, trademarks, trade names, designs, source code, structure and selection of content — are protected by copyright and industrial property law and belong to Easy Trends or to third parties who have authorised their use.

Viewing and reproduction for personal, private use is permitted. Any reproduction, distribution, public communication, transformation or commercial exploitation, in whole or in part, without the prior express written authorisation of the rights holder is prohibited.

Third-party trademarks, logos and distinctive signs shown on the Site belong to their respective owners and appear solely for information or as a reference to collaborations carried out.

Content created by creators within campaigns is governed by the licences agreed in the terms and conditions and in each campaign brief.

6. Third-party links

The Site may contain links to third-party pages, platforms and profiles such as TikTok, Instagram or YouTube. Those links are provided only to make additional information easier to reach.

Easy Trends does not control and accepts no responsibility for the content, terms of use, privacy policies or practices of those sites. We recommend reviewing their own conditions before using them.

7. Disclaimer

We aim to keep published information accurate and up to date, but we do not warrant that it is free of errors, omissions or outdated material. Figures on reach, results or performance are informational and do not constitute a promise of results for any particular campaign.

To the fullest extent permitted by law, Easy Trends is not liable for damage arising from the unavailability of the Site, technical faults, interruptions, viruses or other harmful elements introduced by third parties, or from any misuse of the Site or its information by the user.

Nothing in this notice excludes liability for wilful misconduct or gross negligence, nor limits the non-waivable rights granted to consumers by law.

8. Availability and security

We apply reasonable technical and organisational measures to keep the Site available and to protect the information that travels through it. Even so, access may be suspended temporarily for maintenance, updates or reasons beyond our control, and we will give advance notice where possible.

9. Personal data protection

The processing of personal data collected through the Site is governed by our privacy and personal data policy, which describes the purposes, recipients, retention periods and the rights you can exercise as a data subject.

Please review that policy before sending us personal information through forms or by email. You are not required to provide data that is not necessary for the purpose of your enquiry.

10. Cookies

The Site uses cookies and similar technologies as described in our cookie policy, where you will find which cookies are installed, for what purpose, how long they last and how to manage or delete them.

11. Commercial communications

We will only send commercial communications where there is prior authorisation or a legal basis. All our promotional messages identify the sender and include a simple, free mechanism to stop receiving them. Opting out of marketing does not prevent operational messages related to a request, an account, a contract, a campaign or a payment.

We may change the Site, its services and this legal notice where required by regulatory, technical or operational changes. The version in force is always the one published on this page, with its update date. We recommend reviewing it periodically.

13. Partial invalidity

If a competent authority declares any clause of this notice invalid or ineffective, the remaining clauses stay in force and the affected clause will be interpreted or replaced in line with its original purpose and applicable law.

14. Governing law and jurisdiction

This legal notice is governed by the laws of the Republic of Colombia. Before taking legal action, the parties will attempt to resolve any dispute through a written claim and direct negotiation over fifteen (15) business days.

If no agreement is reached, disputes will be submitted to the competent courts and authorities under the applicable rules of jurisdiction. Consumers retain their right to approach the Superintendency of Industry and Commerce or any other applicable authority.
