Terms and conditions for creators
In force since 16 September 2026
These terms govern creator registration with Easy Trends Agency and participation in the campaigns we coordinate. Please read them before registering or applying to a campaign.
1. Acceptance and scope
These terms govern the registration and participation of content creators in campaigns coordinated by Easy Trends Agency (“Easy Trends”, “we” or the “Agency”). By registering, ticking the acceptance box, applying to a campaign or using our services, you state that you have read, understood and accepted this document and the specific conditions of each campaign.
Electronic acceptance is a valid expression of intent under Law 527 of 1999. You must be at least eighteen (18) years old and have legal capacity to contract. We do not allow minors to register as creators.
2. Identification and contact
Easy Trends Agency coordinates creator campaigns from Zipaquirá, Cundinamarca, Colombia. You can reach us at easytrendsagency@gmail.com or on +57 317 701 2742.
The registered company name, tax ID and address for legal notices applicable to each relationship are stated in the campaign order or specific agreement and in the corresponding payment documents.
3. Definitions
- Creator: an individual accepted to take part in a campaign.
- Brand: the advertiser, artist, label, agency or client commissioning a campaign.
- Campaign: a collaboration with defined instructions, deliverables, dates, channels and payment.
- Content: videos, photographs, text, audio and any other material delivered by the Creator.
- Brief: the specific conditions and approval criteria of each Campaign.
- Payment: the agreed fee for approved deliverables, which may include fixed or variable components.
4. Registration, account and social profiles
You must provide true, complete and up-to-date information, safeguard your credentials and notify us of any unauthorised access. You are responsible for activity carried out from your account, unless you promptly reported a breach beyond your control.
Where a campaign requires it, you must connect or prove ownership of public social media profiles. Use of TikTok, Instagram, YouTube or other platforms is additionally governed by their own terms. Easy Trends does not control the availability, rules or decisions of those platforms.
5. Eligibility and authenticity
Admission and campaign assignment are not guaranteed. We may assess profile fit, audience, quality, previous performance and the objective requirements of the Brief. The Creator undertakes to:
- use their own profiles and metrics obtained legitimately;
- not buy followers, views or engagement, and not use bots or deceptive practices;
- not impersonate others, reuse third-party content without permission or provide false information;
- comply with the law, platform rules and the Brand's safety policies.
6. Taking part in campaigns
Each Campaign has a Brief that may set out available slots, required profile, format, mentions, tags, schedule, how long posts must stay up, the review process, authorised uses and Payment. When you accept a Campaign, the Brief becomes part of this contract. An application does not in itself create a right to payment.
Material changes to the Brief after your acceptance require your approval. We may request reasonable adjustments consistent with the original Brief. Content is deemed approved once the Agency or the Brand confirms it through a verifiable channel.
7. Content rules and transparent advertising
Content must be original, truthful and safe, and must respect copyright, image rights, privacy, trademarks and any other third-party rights. If it features other people, music, works, private locations or protected elements, you must hold the necessary authorisations.
Every commercial post must clearly identify its advertising nature using wording such as “Advertising”, “Sponsored by” or the disclosure required by the platform, the Agency, the Brand or the competent authority. You may not make false claims, hide material information, or present as personal experience something you have not tried or verified.
8. Payment, invoicing and taxes
The amount, currency, conditions, estimated date and payment method are those stated in each Brief or campaign order. Variable components are calculated only on valid metrics within the reported period and up to the Campaign's maximum budget. Easy Trends may verify metrics before releasing payment.
To receive payments you must provide accurate banking, tax and identification information, along with an invoice or equivalent document where legally required. Tax withholdings required by Colombian regulations will be applied according to the nature of the payment and your tax status. Each Creator is responsible for reporting and meeting their own obligations before the DIAN and other authorities.
A payment may be put on hold while incomplete data is corrected, possible fraud is verified, or a breach related to the deliverable is resolved. Any hold will be proportionate, communicated, and will not affect undisputed amounts already due.
9. Rights over the content
You keep your moral rights as an author, which are non-waivable and non-transferable. For each approved and paid piece, you grant Easy Trends and the Brand named in the Brief a licence of economic rights over the Content, strictly within the scope defined in the Campaign.
Unless the Brief expressly sets out other conditions accepted by you, the licence is non-exclusive, worldwide, for twelve (12) months from first publication, and allows reproducing, publicly communicating, making available, distributing and technically adapting the Content for organic publication and paid digital media on channels owned by the Brand and Easy Trends. Adaptations may include cropping, subtitles and changes of format, duration and size, without distorting the work or harming your honour or reputation.
Any exclusivity, assignment, perpetual use, commercial sublicence, use beyond the media above, or use of your image and voice to train or generate content with artificial intelligence must be expressly, specifically and separately agreed in writing and paid for in the Brief or a separate agreement. Where a transfer or exclusivity requires registration to be enforceable against third parties, the parties will cooperate with the filing before the National Copyright Directorate.
10. Image, name and voice
You authorise the use of your stage name, handle, image, voice and biographical details strictly to run and credit the Campaign, within the same territory, term and media as the applicable licence. This authorisation does not allow creating statements you never made or associating you with products or causes outside the Campaign.
11. Prohibited conduct
You may not use the services to infringe rights, introduce malicious software, gain unauthorised access, scrape data automatically, send spam, manipulate metrics, harass, threaten, discriminate, or spread illegal, misleading, sexually explicit or violent content, or content that puts others at risk.
12. Breach and suspension
In the event of a breach we may reject a deliverable, request its correction, suspend participation, cancel a Campaign or close the account, depending on the severity and giving the Creator a reasonable opportunity to explain or remedy the issue — except in cases of fraud, risk to third parties, an order from an authority, or a breach that cannot be remedied. Loss or return of Payment applies only to the affected deliverable and only where there is an objective cause.
13. Independence of the parties
The Creator acts with technical and administrative autonomy. These terms do not create an employment relationship, partnership, agency, general mandate or exclusivity, other than a specific exclusivity agreed in writing for a Campaign. Each party is responsible for its own employment, social security and tax obligations where applicable.
14. Personal data
We process your data to manage registration, select profiles, run campaigns, verify metrics, make payments, prevent fraud and meet legal obligations, in accordance with Law 1581 of 2012 and its implementing rules. You may access, update, correct and, where applicable, delete your data or withdraw your authorisation by writing to easytrendsagency@gmail.com.
Full details of the processing, recipients, retention periods and the procedure for exercising your rights are set out in our privacy and personal data policy.
15. Third-party links and services
The platform may contain third-party links or integrations. We do not control their content, availability or practices. Nothing here limits the liability that legally falls on Easy Trends for its own acts or omissions.
16. Availability and liability
We will work to keep the services available and the information current, but interruptions, errors or force majeure events may occur. To the fullest extent permitted by law, each party is liable for the direct damage attributable to it. No clause excludes non-waivable rights, liability for wilful misconduct or gross negligence, or applicable consumer protections.
17. Termination
You may request closure of your account at any time. Termination does not end campaigns already accepted, outstanding payments, confidentiality duties or licences validly granted over content already approved and paid for. Before final closure you may request payment of amounts due and a copy of the information that must legally be kept or handed over.
18. Changes
We may update these terms due to legal, technical or service changes. We will give reasonable advance notice of any material change and will request fresh acceptance where it alters essential obligations or the scope of rights over the Content. The version applicable to a Campaign is the one accepted at the time of taking part, unless the parties later agree otherwise or a mandatory legal change applies.
19. Governing law and dispute resolution
These terms are governed by the laws of the Republic of Colombia. Before starting proceedings, the parties will attempt to resolve the dispute through a written claim and direct negotiation over fifteen (15) business days. Failing agreement, they may turn to conciliation or to the competent courts and authorities under the applicable rules of jurisdiction. Rights to approach the Superintendency of Industry and Commerce or another authority remain unaffected where applicable.
20. Related documents and contact
These terms are read together with the site's legal notice, privacy policy and cookie policy. Where these documents conflict with a Campaign Brief, the Brief prevails on the matters it specifically regulates.
For questions about these terms, write to easytrendsagency@gmail.com or call +57 317 701 2742.
